I.  How We Collect and Use Your Personal Information

1. Overview

We only collect the information that is necessary for specified, concrete, explicit and legitimate purposes and will ensure that the information is not further processed in a manner that is incompatible with those purposes.

 

2. What information we collect and how we use it  

2.1 To register refund requests and process refunds

When you submit a refund request to us in accordance with our requirements, we will collect your name and contact information (including phone number, email, mailing address, country, state/province, city and Zip Code), the information about the order for which you are requesting a refund (including the product model, quantity , order number, purchase platform, date purchased), proof of purchase and a photo of the side of the product displaying the model numbers. We collect and use this information to register and review your refund request, and contact you for refund processing after review and approval. The lawful basis for processing the information above is compliance with a legal obligation (recalling products arising from relevant product safety laws).

If you purchased the product offline or contact us for the refund request via email, after your refund request is reviewed and approved, we will also collect your account information to wire you a refund. The lawful basis for processing this information is compliance with a legal obligation (recalling products arising from product safety laws).

 

II.  How We Store and Protect Your Personal Information

1. How we store your personal information

The personal information described above will be stored in accordance with the laws and regulations on the personal privacy data protection of the countries concerned.

We will keep the information for the shortest storage period specified by law. For those not specified by law, we will retain the information according to the shortest storage period required for the Services. For data that exceeds the storage period, or data that you request us to delete, we will delete said data accordingly or take other appropriate measures without violating the relevant laws and regulations.

2. How we protect your personal information

We will take other necessary measures to protect the security of your personal information and prevent data from being misused, unauthorized access, and unauthorized modification, disclosure or destruction, etc.

We share your personal information with the following categories of recipient:

  • Group companies: In order to provide you with timely services, your personal information may be shared with our group entities. We will only share your information within our group entities for legitimate and explicit purposes, and only share the information necessary to provide the Services, and are bound by the purposes stated in this Privacy Notice. If a purpose concerned is not included in this Notice, we will state it in the corresponding privacy notice or notice of the specific product or service.

  • Third party providers: We may share the necessary personal information with authorized third-party partners (including technical service providers, data storage service providers, after-sales service providers, third-party SDK service providers, etc.) to provide the Services. Specifically, we will engage a recall service provider, [EXPERT BRAND SOLUTIONS LTD (“Sedgwick”) ], to process the information about you referred to in Article 2 above for the purpose of reviewing your refund request, initiating a refund to you, and completing the whole recall process on our behalf.

  • Any competent law enforcement body, regulatory, government agency, court or other third party: (such as our professional advisers) where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights or so a third party can defend theirs, or (iii) to protect your vital interests or those of any other person;

  •  A buyer (and its agents and advisers) in connection with any purchase, merger or acquisition of any part of our business, provided that we inform the buyer it must use your personal data only for the purposes disclosed in this Privacy Notice; or

  • Any other person with your consent to the disclosure (obtained separately from any contract between us).

 

IV.  How Your Personal Information is Transferred Across Borders

For the purposes described in this Notice, and to the extent permitted by applicable local laws and regulations, we may transfer your personal information to a country other than the country where you are resident.

Specially, personal data relating to the product recall is stored in [Ireland].

Additionally, in some cases, personal data may be transferred to our review team at China Headquarters. We may also transfer your personal information to third-party service providers and business partners operating in other countries or regions.

The privacy protection laws of these countries or regions may be different, and the jurisdiction in which these global resources or servers are located may or may not protect personal information to the same standards as in your jurisdiction. However, we will still strive to comply with our Privacy Notice to protect your personal information, and we will follow the legal requirements of the country or region where the personal information is located to carry out the corresponding cross-border transfer and other processing of personal information.

Where we transfer your personal data to countries or organisations outside of the European Economic Area and the UK, which have been formally recognised as providing an adequate level of protection for personal data, we rely on the relevant “adequacy decisions” from the European Commission and “adequacy regulations" (data bridges) from the Secretary of State in the UK.

Where the transfer is not subject to an adequacy decision or regulations, we have taken appropriate safeguards to ensure that your personal data will remain protected in accordance with this Privacy Notice and applicable laws. The safeguards we use to transfer personal data include the European Commission’s Standard Contractual Clauses as issued on 4 June 2021 under Article 46(2) including the UK Addendum.

  •  If we have collected and processed your personal data with your consent, then you can withdraw your consent at any time by using the contact details provided in this notice.  Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal data conducted in reliance on lawful processing grounds other than consent. 

  • You have the right to complain to a supervisory authority about our collection and use of your personal data.  For more information, please contact your local supervisory authority.
